Breakfast Of The Gods

Okay first off Breakfast Of The Gods is pretty funny - a brutal over-the-top Sin City style comic featuring... breakfast cereal mascots as characters.

But as a parody of famous trademarks, I kind of wonder if creator Brendan Douglas Jones is walking on thin legal ground. When a trademark is famous it's not a question of confusion, even "dilution" is sufficient to create an action. Fair use might save the day even then, but the ultimate answer isn't obvious to me. In any event, just to be safe check it out before General Mills notices it!

Since the comic seems to be

Since the comic seems to be specifically attacking the weird messages cereal advertisements have given us over the years, I'd hope that fair use would still apply.

Of course, copyright law gets more and more powerful all the time. At least for the people who can afford to lobby.

Seems to me to clearly be

Seems to me to clearly be Fair Use in that it's meant to parody the original work, and for a couple of other reasons as well. I would hope that CBLDF would take up the case, should he get a cease and desist.

And the comic itself is A+ material.
